Juli 2019<\/strong> hat die Nationalversammlung der Republik Serbien das <strong>Handelsgesetz<\/strong> und das <strong>Gesetz zur \u00c4nderung des Gesetzes \u00fcber elektronischen Handel<\/strong> verabschiedet.<\/p><ul><li><strong><a href=\"https:\/\/www.paragraf.rs\/propisi\/zakon_o_trgovini.html\" target=\"_blank\" rel=\"noopener\">Das Handelsgesetz<\/a><\/strong> (<em>\u201eAmtsblatt der Republik Serbien\u201c, Nr. 52\/2019<\/em>) trat am <strong>30. Juli 2019<\/strong> in Kraft, ausgenommen Artikel 34 Absatz 8, der erst ab dem <strong>31. Januar 2020<\/strong> gilt.<\/li><li><strong><a href=\"https:\/\/www.paragraf.rs\/propisi\/zakon_o_elektronskoj_trgovini.html\" target=\"_blank\" rel=\"noopener\">Das ge\u00e4nderte Gesetz \u00fcber elektronischen Handel<\/a><\/strong> (<em>\u201eAmtsblatt der Republik Serbien\u201c, Nr. 52\/2019<\/em>) trat ebenfalls am <strong>30. Juli 2019<\/strong> in Kraft, mit Ausnahmen, die erst ab dem <strong>EU-Beitritt Serbiens<\/strong> wirksam werden.<\/li><\/ul><hr \/><h3><strong>Was sind die wichtigsten \u00c4nderungen?<\/strong><\/h3><h4><strong>1. Neue Begriffe:<\/strong><\/h4><ul><li><p><strong>Elektronische Plattform:<\/strong><br \/>Plattformen, die online Produkte oder Dienstleistungen anbieten.<\/p><\/li><li><p><strong>Elektronisches Handelsgesch\u00e4ft:<\/strong><br \/>T\u00e4tigkeiten, die den Verkauf oder die Bereitstellung von Waren und Dienstleistungen \u00fcber das Internet umfassen.<\/p><\/li><\/ul><h4><strong>2. Verpflichtende Registrierung:<\/strong><\/h4><p>Alle elektronischen Plattformen und Handelsgesch\u00e4fte, die mit gesch\u00e4ftlichen Aktivit\u00e4ten verbunden sind, m\u00fcssen gem\u00e4\u00df dem Gesellschaftsgesetz der Republik Serbien registriert werden.<\/p><h4><strong>3. Entfernung von verbotenem Inhalt:<\/strong><\/h4><p>Das Gesetz schreibt vor, wie und wann verbotene Inhalte von elektronischen Plattformen entfernt werden m\u00fcssen. Diese Vorschrift soll den digitalen Handel sicherer machen.<\/p><hr \/><h3><strong>Warum wurden diese \u00c4nderungen eingef\u00fchrt?<\/strong><\/h3><p>Die neuen Regelungen zielen darauf ab, den digitalen Handel und den Online-Verkauf transparenter zu gestalten. Insbesondere:<\/p><ul><li><strong>Rechtssicherheit:<\/strong> Schutz von Verbrauchern vor Missbrauch.<\/li><li><strong>Regulierung von Online-Vertr\u00e4gen:<\/strong> Klare Regeln f\u00fcr E-Commerce-Gesch\u00e4fte.<\/li><li><strong>Bessere Kontrolle:<\/strong> Verpflichtung, illegale oder problematische Inhalte zu entfernen.<\/li><\/ul><hr \/><h3><strong>Relevanz f\u00fcr Unternehmen<\/strong><\/h3><p>Unternehmen, die online t\u00e4tig sind, sollten ihre Prozesse und Plattformen entsprechend den neuen Regelungen anpassen.
