Predmet eksproprijacije mogu biti zemlji\u0161ta, zgrade i drugi gra\u0111evinski objekti, (U daljem tekstu: \u201e<strong>Nepokretnosti<\/strong>\u201c).Eksproprijacijom mo\u017ee da se ustanovi i slu\u017ebenost na Nepokretnosti ili zakup na zemlji\u0161tu na odre\u0111eno vreme (nepotpuna eksproprijacija).<\/span><\/p><p style=\"margin-top: 0cm; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span lang=\"SR-LATN-RS\" style=\"font-size: 10.5pt; font-family: Roboto;\">Nepokretnosti se mogu eksproprisati ili se svojina na njima mo\u017ee ograni\u010diti samo u javnom interesu utvr\u0111enom na osnovu zakona, uz naknadu koja ne mo\u017ee biti ni\u017ea od tr\u017ei\u0161ne.<\/span><\/p><p style=\"margin-top: 0cm; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span lang=\"SR-LATN-RS\" style=\"font-size: 10.5pt; font-family: Roboto;\">Nakon sprovedenog Zakonom utvr\u0111enog postupka eksproprijacije donosi se re\u0161enje o eksproprijaciji. Kada re\u0161enje o eksproprijaciji postane pravnosna\u017eno op\u0161tinska uprava du\u017ena je da odmah bez odlaganja zaka\u017ee i odr\u017ei raspravu za sporazumno odre\u0111ivanje naknade za eksproprisanu nepokretnost. Ukoliko se ne zaklju\u010di sporazum o visini naknade za eksproprisanu Nepokretnost o visini naknade odlu\u010duje sud u vanparni\u010dnom postupku.<\/span><\/p><p style=\"margin-top: 0cm; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span lang=\"SR-LATN-RS\" style=\"font-size: 10.5pt; font-family: Roboto;\">Vrednost objekta koji se daje u svojinu ili susvojinu na ime naknade i vrednost eksproprisanog objekta, u slu\u010daju zasnivanja prava svojine ili susvojine, odre\u0111uje se prema tr\u017ei\u0161noj ceni tih objekata u momentu zasnivanja prava svojine, odnosno susvojine. Visina naknade u novcu za eksproprisane nepokretnosti odre\u0111uje se po tr\u017ei\u0161noj ceni, prema okolnostima u momentu zaklju\u010denja sporazuma o visini naknade, a ako sporazum nije postignut, prema okolnostima u momentu dono\u0161enja prvostepene odluke o naknadi.<\/span><\/p><p style=\"margin-top: 0cm; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span lang=\"SR-LATN-RS\" style=\"font-size: 10.5pt; font-family: Roboto;\">U slu\u010daju kada je do\u0161lo do eksproprijacije, odnosno do ograni\u010denja u\u017eivanja prava svojine u javnom interesu i na osnovu zakona, a da nije doneto re\u0161enje nadle\u017enog organa o eksproprijaciji, onda govorimo o institutu \u201efakti\u010dke eksproprijacije\u201c. Ovaj termin ustanovljen je praksom Evropskog suda za ljudska prava prilikom re\u0161avanja brojnih predmeta u ovakvim situacijama.<\/span><\/p><p style=\"margin-top: 0cm; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span lang=\"SR-LATN-RS\" style=\"font-size: 10.5pt; font-family: Roboto;\">Praksa doma\u0107ih sudova u sudskim sporovima povodom eksproprijacije nepokretnosti u slu\u010dajevima kada nije bilo doneto re\u0161enje o eksproprijaciji zasnivala se na primeni relevantnih odredaba Zakona o eksproprijaciji. Ovakva praksa je prekinuta kada je Narodna skup\u0161tina RS donela autenti\u010dno tuma\u010denje odredaba \u010dlana 1, \u010dlana 5. stav 1. i \u010dlana 53. st. 1. i 2. Zakona o eksproprijaciji (&#8222;slu\u017ebeni glasnik RS&#8220;, br. 53\/95, 23\/01 &#8211; sus, 20\/09 i 55\/13 &#8211; US) objavljeno u slu\u017ebenom glasniku 28.12.2016. godine i onemogu\u0107ila primenu Zakona u situacijama kada je do\u0161lo do ograni\u010denja u\u017eivanja prava svojine u javnom interesu i na osnovu zakona, a da nije doneto re\u0161enje nadle\u017enog organa o eksproprijaciji.<\/span><\/p><p style=\"margin-top: 0cm; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span lang=\"SR-LATN-RS\" style=\"font-size: 10.5pt; font-family: Roboto;\">Nakon dono\u0161enja tuma\u010denja Zakona, odluke sudova zasnivale su se na izvorima me\u0111unarodnog prava kao \u0161to je Evropska konvencija o za\u0161titi ljudskih prava, kao i na doma\u0107e izvore kao \u0161to je Ustav Republike Srbije koji jem\u010di mirno u\u017eivanje svojine i drugih imovinskih prava ste\u010denih na osnovu zakona i da pravo svojine mo\u017ee biti oduzeto ili ograni\u010deno samo u javnom interesu utvr\u0111enom na osnovu zakona, uz naknadu koja ne mo\u017ee biti ni\u017ea od tr\u017ei\u0161ne.<\/span><\/p><p style=\"margin-top: 0cm; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span lang=\"SR-LATN-RS\" style=\"font-size: 10.5pt; font-family: Roboto;\">Naj\u010de\u0161\u0107i primer u praksi je kada privatno zemlji\u0161te planskim aktom jedinice lokalne samouprave bude odre\u0111eno za ulicu i kada se to fakti\u010dki i sprovede. Od tog momenta po sili zakona privatno zemlji\u0161te postaje sredstvo u javnoj svojini jedinice lokalne samouprave. <\/span><\/p><p style=\"margin-top: 0cm; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span lang=\"SR-LATN-RS\" style=\"font-size: 10.5pt; font-family: Roboto;\">Zbog toga jedinica lokalne samouprave ima obavezu da zemlji\u0161te koje je postalo sredstvo javne svojine ekspropri\u0161e ranijem vlasniku odnosno da ga izuzme iz poseda ranijeg vlasnika i da za to plati odgovaraju\u0107u naknadu. <\/span><\/p><p style=\"margin-top: 0cm; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span lang=\"SR-LATN-RS\" style=\"font-size: 10.5pt; font-family: Roboto;\">U situaciji kada je zemlji\u0161te kao u ovom slu\u010daju privedeno nameni u skladu sa planskim aktom i po sili zakona postalo javna svojina, vlasnik zemlji\u0161ta ne bi trebalo da trpi \u0161tetne posledice \u0161to nadle\u017eni organ nije sproveo upravni postupak i doneo re\u0161enje o izuzimanju zemlji\u0161ta iz poseda koje bi bilo osnov za isplatu naknade za izuzeto zemlji\u0161te. <\/span><\/p><p style=\"margin-top: 0cm; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span lang=\"SR-LATN-RS\" style=\"font-size: 10.5pt; font-family: Roboto;\">Iz prakse primene Protokola 1 uz Evropsku konvenciju za za\u0161titu ljudskih prava, \u010diji je Republika Srbija potpisnik, Evropski sud za ljudska prava u velikom broju odluka izra\u017eava stav da se kod eksproprijacije mora posti\u0107i ravnote\u017ea izme\u0111u zahteva op\u0161teg interesa i prava pojedinca na mirno u\u017eivanje svog vlasni\u0161tva pri \u010demu odsustvo naknade za eksproprisanu imovinu u iznosu koji nije u skladu sa vredno\u0161\u0107u nepokretnosti redovno predstavlja nesrazmerno me\u0161anje dr\u017eave. <\/span><\/p><p style=\"margin-top: 0cm; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span lang=\"SR-LATN-RS\" style=\"font-size: 10.5pt; font-family: Roboto;\">Tako\u0111e, ako se pojedincu za oduzetu nepokretnost ne plati nikakva naknada povreda prava na u\u017eivanje imovine je jo\u0161 drasti\u010dnija. Evropski sud upotrebljava termin \u201efakti\u010dka eksproprijacija\u201c smatraju\u0107i da povreda prava na mirno u\u017eivanje imovine postoji sve do onog momenta kada do\u0111e do uspostavljanja ravnote\u017ee interesa, a to \u0107e biti tek kada se vlasnik adekvatno obe\u0161teti.<\/span><\/p><p style=\"margin-top: 0cm; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span lang=\"SR-LATN-RS\" style=\"font-size: 10.5pt; font-family: Roboto;\">Ovakav stav potvr\u0111uje i brojne novije odluke sudova i to: Vrhovnog kasacionog suda, Rev 2083\/2017 13.06.2018. godina, Rev 7\/2017 20.04.2017. godina, Apelacionog suda G\u017e.2084\/17 od 24.08.2017. godine i Ustavnog suda \u0423\u0436\u2013472\/2014 od 25.02.2016.<\/span><\/p><p style=\"margin-top: 0cm; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><b><span lang=\"SR-LATN-RS\" style=\"font-size: 10.5pt; font-family: Roboto;\"><br \/><strong><a href=\"https:\/\/law-firm.rs\/sr\/nas-tim\/\">Advokat Stefan Mojsi\u0107<\/a><\/strong><\/span><\/b><\/p><p style=\"margin-top: 0cm; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><em><span lang=\"SR-LATN-RS\" style=\"font-size: 10.5pt; font-family: Roboto;\">Informacije sadr\u017eane u ovom tekstu su pru\u017eene samo za svrhu op\u0161te informisanosti, nisu pru\u017eene i ne mogu se smatrati za pravno mi\u0161ljenje ili pravni savet.
