Dva su slu\u010daja kada se mogu pojaviti titulari prava pre\u010de kupovine:<\/p><ol><li>kada suvlasnik namerava da proda svoj suvlasni\u010dki udeo u nepokretnosti;<\/li><li>kada vlasnik poljoprivrednog zemlji\u0161ta namerava da ga proda.<\/li><\/ol><h4><strong style=\"color: var( --e-global-color-text ); font-family: var( --e-global-typography-text-font-family ), Sans-serif; background-color: transparent;\">Prodaja suvlasni\u010dkog udela u nepokretnosti<\/strong><\/h4><p>U situaciji kada suvlasnik nepokretnosti namerava da proda svoj suvlasni\u010dki deo, on je najpre du\u017ean da ga prethodno ponudi na prodaju ostalim suvlasnicima.<\/p><p>Ukoliko ima vi\u0161e suvlasnika, \u0161to je u praksi \u010dest slu\u010daj, prvenstvo u ostvarivanju prava pre\u010de kupovine ima <em>suvlasnik sa ve\u0107im suvlasni\u010dkim udelom<\/em>. Ako postoji vi\u0161e suvlasnika sa jednakim suvlasni\u010dkim udelom, onda suvlasnik nepokretnosti ima <em>pravo da sam odlu\u010di kome \u0107e od njih prodati svoj deo nepokretnosti.<\/em><\/p><h4><strong>Prodaja poljoprivrednog zemlji\u0161ta<\/strong><\/h4><p>Pravo pre\u010de kupovine se javlja i ukoliko vlasnik poljoprivrednog zemlji\u0161ta namerava da ga proda, imaju\u0107i u vidu da je du\u017ean da ga prethodno ponudi vlasniku susednog poljoprivrednog zemlji\u0161ta.<\/p><p>Ako postoji vi\u0161e vlasnika susednih parcela, prvenstvo u ostvarivanju prava pre\u010de kupovine ima vlasnik susednog zemlji\u0161ta \u010dije se poljoprivredno zemlji\u0161te <em>prete\u017enim delom grani\u010di sa zemlji\u0161tem prodavca<\/em>. Dok ukoliko se poljoprivredno zemlji\u0161te koje se prodaje jednakim delom grani\u010di sa svim susednim parcelama, pravo pre\u010de kupovine \u0107e imati <em>vlasnik \u010dija je povr\u0161ina parcele najve\u0107a<\/em>.<\/p><h5><strong>Koje su obaveze vlasnika nepokretnosti?<\/strong><\/h5><p>Kako je prethodno re\u010deno, suvlasnik nepokretnosti, kao i vlasnik poljoprivrednog zemlji\u0161ta ima obavezu da uputi ponudu suvlasniku, odnosno vlasniku susednog poljoprivrednog zemlji\u0161ta. Ova ponuda mora da sadr\u017ei podatke o nepokretnosti, ceni i ostalim uslovima prodaje i mora biti sastavljena u pismenom obliku.<\/p><p>Sa druge strane, imalac prava pre\u010de kupovine du\u017ean je da se u roku od 15 dana od dana prijema ponude pismenim putem izjasni o ponudi.<\/p><p>Tek ako se imalac prava pre\u010de kupovine, kome je u\u010dinjena ponuda, u roku od 15 dana od dana prijema ponude, ne izjasni da prihvata ponudu, prodavac mo\u017ee prodati nepokretnost drugom licu, <strong>ali ne pod povoljnijim uslovima.<\/strong><\/p><p>Ukoliko imalac prava pre\u010de kupovine ne prihvati ponudu, a vlasnik tu nepokretnost ne proda ni tre\u0107em licu u roku od jedne godine od dana neprihvatanja ponude, du\u017ean je da u slu\u010daju ponovne prodaje opet ponovi postupak obave\u0161tavanja suvlasnika, odnosno vlasnika susednog poljoprivrednog zemlji\u0161ta.<\/p><h5><strong>Povreda prava pre\u010de kupovine<\/strong><\/h5><p>Povreda prava pre\u010de kupovine postoji u tri slu\u010daja:<\/p><ul><li>kada vlasnik proda nepokretnost, a prethodno je ne ponudi imaocu prava pre\u010de kupovine, odnosno ne uputi mu pisanu ponudu sa svim elementima koje mora da sadr\u017ei;<\/li><li>kada vlasnik uputi uredno sastavljenu ponudu imaocu prava pre\u010de kupovine, ali nepokretnost proda tre\u0107em licu pod povoljnijim uslovima od onih koji su bili navedeni u ponudi;<\/li><li>kada vlasnik nepokretnost preda kupcu u dr\u017eavinu, a ne zaklju\u010di ugovor o prodaji nepokretnosti u obliku propisanim Zakonom o prometu nepokretnosti.<\/li><\/ul><p>U navedenim slu\u010dajevima, odnosno kada do\u0111e do povrede prava pre\u010de kupovine, <strong>imalac prava pre\u010de kupovine mo\u017ee podneti tu\u017ebu nadle\u017enom sudu<\/strong>. Ovom tu\u017ebom imalac prava pre\u010de kupovine zahteva da se ugovor o prodaji nepokretnosti oglasi bez dejstva \u00a0bez dejstva prema njemu i da mu se nepokretnost proda i preda pod istim uslovima.<\/p><h5><strong>Koji je rok za podno\u0161enje tu\u017ebe?<\/strong><\/h5><p>Subjektivni rok u kome se mo\u017ee podneti tu\u017eba ukoliko do\u0111e do povrede prava pre\u010de kupovine iznosi <em>30 dana od dana kada je imalac prava pre\u010de kupovine saznao za prodaju te nepokretnosti<\/em>, dok je objektivni rok u kome se mo\u017ee podneti tu\u017eba <em>dve godine od dana zaklju\u010denja ugovora o prodaji nepokretnosti<\/em>.<\/p><p>Ukoliko je do povrede prava pre\u010de kupovine do\u0161lo tako \u0161to je nepokretnost predata u dr\u017eavinu kupcu, a nije zaklju\u010den ugovor o prodaji nepokretnosti, onda subjektivni rok za podno\u0161enje tu\u017ebe iznosi <em>godinu dana od dana saznanja za prenos dr\u017eavine<\/em>, a objektivni rok iznosi <em>dve godine od dana predaje nepokretnosti kupcu u dr\u017eavinu<\/em>.<\/p><p>Ono \u0161to je specifi\u010dnost ove tu\u017ebe jeste da tu\u017eilac istovremeno sa podno\u0161enjem tu\u017ebe mora da polo\u017ei kod nadle\u017enog suda u sudski depozit iznos u visini tr\u017ei\u0161ne vrednosti nepokretnosti na dan podno\u0161enja tu\u017ebe.<\/p><p>\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0
