Sa druge strane, kao zaposleni, korisno je da budete upoznati sa svojim pravima i mogu\u0107im razlozima za otkaz ugovora o radu. Bilo da ste poslodavac ili zaposleni, u nastavku teksta mo\u017eete saznati kako da za\u0161titite svoja prava.<\/p>\n\n\n\n<h4 id=\"h-zakon-o-radu-propisuje-cetiri-grupe-opravdanih-razloga-za-otkaz-ugovora-o-radu\"><a href=\"https:\/\/www.paragraf.rs\/propisi\/zakon_o_radu.html\" target=\"_blank\" rel=\"noopener\">Zakon o radu<\/a> propisuje \u010detiri grupe opravdanih razloga za otkaz ugovora o radu. <\/h4>\n\n\n\n<p><strong>Prva grupa<\/strong> se odnosi na <strong>radnu sposobnost zaposlenog i njegovo pona\u0161anje<\/strong>, te se u tom slu\u010daju ugovor mo\u017ee raskinuti ako zaposleni ne ostvaruje rezultate rada, nema potrebna znanja i sposobnosti za obavljanje poslova, ili je pravnosna\u017eno osu\u0111en za krivi\u010dno delo na radu ili u vezi sa radom. Ukoliko se zaposleni ne vrati na radno mesto u roku od 15 dana od dana isteka mirovanja radnog odsustva ili nepla\u0107enog odsustva, ovakav postupak zaposlenog ima za posledicu otkaz ugovora o radu od strane poslodavca.<\/p>\n\n\n\n<p><strong>Druga grupa<\/strong> se odnosi na <strong>povredu radne obaveze<\/strong>, gde se ugovor o radu mo\u017ee raskinuti ako zaposleni svojom krivicom u\u010dini ovu povredu. Primeri povrede radne obaveze su nesavesno ili nemarno izvr\u0161avanje radnih obaveza, zloupotreba polo\u017eaja ili prekora\u010denje ovla\u0161\u0107enja, necelishodno i neodgovorno kori\u0161\u0107enje sredstava rada ili neodgovorno kori\u0161\u0107enje opreme za li\u010dnu za\u0161titu na radu, kao i povrede radne obaveze koje su utvr\u0111ene nekim od op\u0161tih akata ili ugovorom o radu.<\/p>\n\n\n\n<p><strong>Tre\u0107a grupa<\/strong> se odnosi na <strong>nepo\u0161tovanje radne discipline<\/strong>, \u0161to mo\u017ee uklju\u010divati odbijanje obavljanja poslova i izvr\u0161avanje naloga poslodavca, nedostavljanje potvrde o privremenoj spre\u010denosti za rad, zloupotrebu prava na odsustvo zbog privremene spre\u010denosti za rad ili dolazak na rad pod dejstvom alkohola ili drugih opojnih sredstava, ali i ako je pona\u0161anje zaposlenog takvo da ne mo\u017ee da nastavi rad kod poslodavca.<\/p>\n\n\n\n<p>Kona\u010dno, <strong>\u010detvrta grupa<\/strong> se odnosi na <strong>ekonomske i organizacione razloge<\/strong>, koji se mogu pojaviti u slu\u010daju restrukturiranja poslovanja ili smanjenja potreba za radnom snagom.<\/p>\n\n\n\n<h4>Neopravdani otkazni razlozi<\/h4>\n\n\n\n<p><strong>Zakon o radu propisuje i \u0161ta se ne mo\u017ee smatrati opravdanim razlogom za otkaz ugovora o radu.<\/strong> To uklju\u010duje privremenu spre\u010denost za rad usled bolesti, nesre\u0107e na radu ili profesionalnog oboljenja, kori\u0161\u0107enje porodiljskog odsustva, odsustva sa rada radi nege deteta i odsustva sa rada radi posebne nege deteta, odslu\u017eenje ili doslu\u017eenje vojnog roka, \u010dlanstvo u politi\u010dkoj organizaciji, sindikatu, pol, jezik, nacionalna pripadnost, socijalno poreklo, veroispovest, politi\u010dko ili drugo uverenje ili neko drugo li\u010dno svojstvo zaposlenog, delovanje u svojstvu predstavnika zaposlenih, kao i obra\u0107anje zaposlenog sindikatu ili organima nadle\u017enim za za\u0161titu prava iz radnog odnosa u skladu sa zakonom, op\u0161tim aktom i ugovorom o radu. Za\u0161titu prava u vezi sa godi\u0161njim odmorom smo ve\u0107 obradili na na\u0161em <a href=\"https:\/\/law-firm.rs\/sr\/godisnji-odmor-radno-pravo\/\">blogu<\/a>.<\/p>\n\n\n\n<p>Kada se ugovor o radu otkazuje, poslodavac mora po\u0161tovati odre\u0111ene korake kako bi postupak bio zakonit. Ti koraci uklju\u010duju davanje upozorenja o postojanju razloga za otkaz i izdavanje re\u0161enja o otkazu ugovora o radu.<\/p>\n\n\n\n<p>Ako se ugovor o radu otkazuje zbog povrede radne obaveze ili nepo\u0161tovanja radne discipline, <strong>poslodavac mora pisanim putem upozoriti zaposlenog na postojanje razloga za otkaz i dati mu rok od najmanje osam dana da se izjasni o navodima u upozorenju<\/strong>. <\/p>\n\n\n\n<p>U praksi je \u010desto sporno dostavljanje upozorenja. Naime, upozorenje se dostavlja li\u010dno, u prostorijama poslodavca, a ako zaposleni nije tu, \u0161alje se na adresu prebivali\u0161ta ili boravi\u0161ta zaposlenog. Ako poslodavac zaposlenom ne mo\u017ee na neki od ovih na\u010dina da dostavi upozorenje, du\u017ean je da o tome sa\u010dini pismenu bele\u0161ku. Tada se upozorenje objavljuje na oglasnoj tabli poslodavca i po isteku osam dana od dana objavljivanja smatra se dostavljenim.<\/p>\n\n\n\n<p>Re\u0161enje o otkazu ugovora o radu se izdaje u pisanom obliku i mora sadr\u017eavati obrazlo\u017eenje i pouku o pravnom leku. Re\u0161enje se dostavlja na isti na\u010din kao i upozorenje, a zaposleni prestaje radni odnos danom dostavljanja re\u0161enja, osim ako je Zakonom ili re\u0161enjem odre\u0111en drugi rok.<\/p>\n\n\n\n<p>U slu\u010daju prestanka radnog odnosa, poslodavac je du\u017ean isplatiti zaposlenom sve neispla\u0107ene zarade, naknade zarade i druga primanja koja je zaposleni ostvario do dana prestanka radnog odnosa u skladu s op\u0161tim aktom i ugovorom o radu. Poslodavac ima rok od 30 dana od dana prestanka radnog odnosa da izvr\u0161i ove isplate.<\/p>\n\n\n\n<h4>Ko je za\u0161ti\u0107en od otkaza ugovora o radu?<\/h4>\n\n\n\n<p><strong>Odre\u0111ene kategorije zaposlenih su za\u0161ti\u0107ene od otkaza ugovora o radu<\/strong>. To uklju\u010duje trudnice, \u017eene na porodiljskom odsustvu, zaposlene na odsustvu radi nege deteta i odsustvu radi posebne nege deteta. Mo\u017ee se \u017ealiti na odluku poslodavca ili pokrenuti sudski postupak.
