ALTA Bank bankruptcy: illustration of debt, financial risk and claim deadlines

Petrović Mojsić & Partners assists domestic and international clients with ALTA Bank bankruptcy matters in Serbia. We review deposit documentation, assess insurance coverage and uninsured claims, and prepare the legal steps needed to protect a creditor’s position.

Our Belgrade-based team can assist foreign individuals, companies and non-resident depositors with document preparation and representation through a power of attorney.

Status checked: 4 November 2026. The Deposit Insurance Agency announced on 3 November that the Commercial Court in Belgrade had commenced bankruptcy proceedings against ALTA banka a.d. Beograd and appointed the Agency as bankruptcy administrator. Banka Poštanska štedionica has been selected as the paying bank for insured deposits. The Agency stated that the payment start date and participating branches would be announced by 6 November.

The case reference and the calendar deadline for filing creditors’ claims still need to be checked against the court’s decision and official notice. The insured-deposit payment timetable is separate from the deadline for filing an uninsured claim.

Official sources: Agency announcement of 3 November and National Bank of Serbia licence announcement.

ALTA Bank Bankruptcy: Insured and Uninsured Deposits

Eligible deposits are protected up to EUR 50,000 per depositor per bank. The limit applies to the depositor’s combined eligible balances, rather than separately to each current account, savings account or fixed-term deposit.

Individuals, entrepreneurs and qualifying micro, small and medium-sized legal entities fall within the statutory framework, subject to exclusions. Large legal entities and certain other categories of deposits are outside the insurance scheme. Eligibility must be assessed separately from the amount held in the account.

The insured amount is assessed using the depositor’s eligible balances at the commencement of proceedings, including the relevant accrued contractual interest. Foreign-currency conversion and statutory exclusions must be checked against the Agency’s calculation. Amounts above the insured limit, and claims outside the scheme, require separate assessment for recovery through bankruptcy.

Claims Above EUR 50,000

For an uninsured claim, our initial review establishes the account holder, the contractual basis of the deposit, the balance and supporting evidence. We also examine any insurance payment, security arrangement or obligation owed to the bank that may affect the amount claimed.

For example, an eligible EUR 80,000 deposit may comprise up to EUR 50,000 within the insurance limit and an uninsured balance of EUR 30,000. This simplified example assumes full eligibility and no other adjustment. It is not a guarantee of recovery of the uninsured balance.

We advise on the classification of the claim, prepare supporting calculations and documentation, and monitor its examination and any proposed distributions.

Filing a Claim and Checking the Deadline

ALTA Bank bankruptcy claims must be considered under Serbia’s special legislation for the bankruptcy and liquidation of banks. The rules for ordinary company bankruptcy should not be applied without checking the special regime.

Under Article 7 of the special law, the court sets a filing period of between 30 and 90 days from publication of the notice of commencement in the Official Gazette of the Republic of Serbia. The actual deadline must be calculated from the relevant court decision and official publication. It should not be calculated from media reports or the licence withdrawal date.

Our work includes verifying the competent court and case reference, identifying the filing requirements, preparing and submitting the claim, and keeping proof of timely submission. If a claim is disputed, we assess the available procedural steps and any separate litigation required.

Foreign and Non-Resident Depositors

Foreign citizenship or non-resident status does not, by itself, exclude an individual depositor from the statutory deposit insurance framework. Corporate eligibility requires its own review, including the entity’s status and the relevant accounting classification.

We help clients abroad identify the required documents, arrange appropriate authorisation and obtain Serbian translations where needed. Notarisation, legalisation or an apostille may depend on the document, country of execution and applicable treaty.

Remote legal representation can often be arranged. Any separate identification or payment requirements imposed by the paying bank or the Deposit Insurance Agency must also be checked.

Frequently Asked Questions

When will insured deposits be paid?

The statutory framework requires access to insured amounts within seven business days of the court’s opening decision. Poštanska štedionica has been selected as paying bank. As of this update, the Agency has announced that the start date and branch network will be published by 6 November; depositors should check the official payment notice and identification requirements.

Does collecting an insured amount recover the whole deposit?

No. Deposit insurance and recovery of an uninsured balance are separate processes. Any amount already recovered must be taken into account so that the same debt is not claimed twice.

Can you guarantee recovery of an uninsured balance?

No. Recovery depends on the admitted claim, its legal ranking, available assets and the outcome of the proceedings.

What should I send for an initial assessment?

Start with the deposit agreement, recent statements and correspondence from the bank or Agency. Include the account holder’s name, approximate balance and any notice or deadline received. We will confirm any additional identification and authorisation documents needed.
